Legal Information and Acceptance
These provisions regulate the use of the Internet portal service (hereinafter, the ‘Portal’) provided by LYRWIRS, SL (hereinafter, Miñarent) to Internet users.
LYRWIRS, SL, with its registered office at Avd. Juan XXIII, No. 12, 29003, Málaga, and Tax Identification Number B29441938, is registered in the Commercial Registry of Málaga, volume 1171, book 84, page 16, general corporate section, sheet MA-3788, entry 1.
Miñarent holds the corresponding administrative authorization as provided for in Law 16/1987, of July 30, on Land Transport, and in Royal Decree 1211/1990, of September 28, which enables it to provide vehicle rental services.
Access to the website is free, except for the cost of the connection through the telecommunications network provided by the access provider contracted by users. Certain services are exclusive to our clients, and access to them is restricted. Specific conditions, regulations, and instructions may be established, which, if applicable, replace, complete, and/or modify this Legal Notice and must be accepted by the User before the provision of the corresponding service begins.
The services provided by MIÑARENT will have the price indicated, if applicable, in each of the commercial offers that this entity makes available to its clients and/or potential clients. The use of these services offered to Users through the Portal is subject to their own specific conditions (hereinafter, the “Specific Conditions”) which, in some cases, replace, complete, and/or modify this legal notice. Therefore, before using such services, the User must also carefully read the corresponding Specific Conditions.
The use of the Portal grants the User the status of Portal user (hereinafter, the ‘User’) and implies acceptance of all the conditions included in this Legal Notice. The provision of the Portal service has a limited duration at the moment the User is connected to it or to any of the services provided through it. Therefore, the User must carefully read this Legal Notice each time they intend to use the Portal, as it and its conditions of use may be subject to modifications.
Intellectual and Industrial Property
All the contents of the Portal, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound contents, as well as their graphic design and source code (hereinafter, the “Contents”), are the intellectual property of MIÑARENT or third parties. The User is not granted any exploitation rights over them under the current legislation on intellectual property, except those that are strictly necessary for the use of the Portal.
The trademarks, trade names, or distinctive signs are the property of MIÑARENT, and accessing the Portal does not imply the granting of any rights over these trademarks, trade names, and/or distinctive signs.
Conditions of Use of the Portal
3.1 General
The User undertakes to use the Portal correctly in accordance with the law and this Legal Notice. The User will be liable to MIÑARENT or third parties for any damages and losses that may be caused as a result of the breach of this obligation.
The use of the Portal for purposes that harm the assets or interests of MIÑARENT or third parties, or in any way overload, damage, or disable the computer networks, servers, and other computer equipment (hardware) or software and computer applications (software) of MIÑARENT or third parties, is expressly prohibited.
3.2 Contents
The User agrees to use the Contents in accordance with the law and this Legal Notice, as well as with any other conditions, regulations, and instructions that may apply, as provided in clause 1 – specific conditions -.
In particular, in accordance with current legislation, the User must refrain from:
Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Contents, except in cases authorized by law or expressly consented to by MIÑARENT or the owner of the exploitation rights, where applicable.
Reproducing or copying, for private use, Contents that may be considered as Software or Databases in accordance with current legislation on intellectual property, as well as their public communication or making them available to third parties when these actions necessarily involve reproduction by the User or a third party.
Extracting and/or reusing all or a substantial part of the Contents comprising the Portal, as well as the databases that MIÑARENT makes available to Users.
3.3 Introduction of Links to the Portal
Internet users who want to introduce links from their own web pages to the Portal must comply with the following conditions, and ignorance of these conditions will not exempt them from the responsibilities established by law:
The use of iframes or frames of any kind that surround the Portal or allow the visualization of the Contents through Internet addresses different from those of the Portal is expressly prohibited, unless expressly authorized by MIÑARENT in accordance with applicable and current legislation, provided that they do not cause errors, confusion, or deception in users regarding the true origin of the service or Contents; (II) constitute an act of unfair comparison or imitation; (III) serve to exploit the reputation and prestige of MIÑARENT; or (IV) are otherwise prohibited by current legislation.
No false, inaccurate, or incorrect statements about MIÑARENT, its partners, employees, customers, or the quality of the services it provides shall be made from the page that introduces the link.
In no case shall it be stated on the page where the link is located that MIÑARENT has given its consent for the insertion of the link or that it otherwise sponsors, collaborates, verifies, or supervises the sender’s services, unless expressly authorized by MIÑARENT. In such cases, a direct link to the Portal in the manner established in this clause shall be permitted.
The page establishing the link must fully comply with the law and shall not, under any circumstances, display or link to its own or third-party contents that are unlawful, harmful, denigrating, violent, or contrary to morals (pornographic, violent, racist, etc.); (II) induce or may induce in the User a false conception that MIÑARENT subscribes to, supports, adheres to, or in any way supports the ideas, statements, or expressions, whether lawful or unlawful, of the sender; (III) be inappropriate or not relevant to MIÑARENT’s activity, given the location, content, and theme of the sender’s website.
Exclusion of Liability
4.1 Quality of Service
Access to the Portal does not imply an obligation on the part of MIÑARENT to control the absence of viruses, worms, or any other harmful computer elements. It is the User’s responsibility, in any case, to have appropriate tools for detecting and disinfecting harmful computer programs.
MIÑARENT shall not be responsible for any damage caused to the computer equipment of Users or third parties during the provision of the Portal service.
4.2 Availability of the Service
Access to the Portal requires services and supplies from third parties, including telecommunications network transportation, the reliability, quality, continuity, and functioning of which are not the responsibility of MIÑARENT. Therefore, the services provided through the Portal may be suspended, canceled, or become inaccessible, either prior to or simultaneously with the provision of the Portal service.
MIÑARENT is not responsible for any damages or harm of any kind suffered by the User resulting from failures or disconnections in the telecommunications networks that cause the suspension, cancellation, or interruption of the Portal service during its provision or prior to it.
4.3 Contents and Services Linked through the Portal
The service of access to the Portal includes technical linking devices, directories, and even search instruments that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In these cases, MIÑARENT acts as a provider of intermediary services in accordance with article 17 of Law 34/2002, of July 12, on Services of the Information Society and Electronic Commerce (LSSI), and will only be responsible for the content and services provided on the Linked Sites to the extent that it has effective knowledge of their illegality and has not disabled the link with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, they may communicate this to MIÑARENT in accordance with the procedure and effects established in clause 5, without this communication implying any obligation to remove the corresponding link in any case.
In no case should the existence of Linked Sites presuppose the existence of agreements with their owners or managers, nor the recommendation, promotion, or identification of MIÑARENT with the statements, contents, or…
Reporting of Illegal and Inappropriate Activities
In the event that the User or any other Internet user becomes aware that Linked Sites refer to pages whose content or services are illegal, harmful, defamatory, violent, or contrary to morality, or that any of the information included by Users themselves, through the services offered on the Portal, has a similar nature as described above, you may contact malaga@minarent.net indicating the following details:
Personal information of the notifier: name, address, telephone number, and email address;
Description of the facts that reveal the illegal or inappropriate nature of the Linked Site;
In the case of rights violations, such as intellectual and industrial property, the personal information of the holder of the infringed right when different from the notifier. You must also provide proof of the legitimacy of the right holder and, if applicable, the representation to act on behalf of the right holder when different from the notifier;
Explicit statement that the information contained in the complaint is accurate.
The receipt of the communication provided for in this clause by MIÑARENT will not, as provided in the LSSI, imply effective knowledge of the activities and/or contents indicated by the notifier.
You must also provide proof of the legitimacy of the right holder and, if applicable, the representation to act on behalf of the right holder when different from the notifier; Explicit statement that the information contained in the complaint is accurate.
The receipt of the communication provided for in this clause by MIÑARENT will not, as provided in the LSSI, imply effective knowledge of the activities and/or contents indicated by the notifier.
